The Safety Health & Welfare at Work Act 2005 came into effect on September 1st 2005. It will be followed by significant additional legislation aimed at improving health & safety in all work places.

The main impact of the new legislation is increased duties and responsibilities on a range of parties including employers, landlords and other persons in control of work places. Critical to these duties is the requirement for a relevant and up to date Safety Statement, a written document outlining the arrangements by which health & safety is being managed. Key elements include:

  • Organisation & arrangements by which health & safety is being managed
  • Identification of hazards and assessment of risks
  • Measures by which risks are managed/prevented
  • Systems and procedures for managing safety including emergency arrangements
  • Training and communications requirements

A significant element of the act included increased duties on directors, managers and officers as well as new responsibilities on employers who commission construction works
